Policies and Procedures
PRODUCT RETURNS FOR NON-TECHNICAL REASONS. For un-opened,
non-defective standard stock item Products that are returned or refused without
any cause, provided that all such returned or rejected Products
must be authorized by a RMA within fourteen (14) days of the invoice
date. Non-defective Products which were special ordered for Buyer
(i.e. not standard stock items) that meet manufacturer's specifications
will not be accepted for return. RMA requests for all non-technical
returns are handled through Seller's Technical RMA department.
CLAIMS OF PRODUCT SHORTAGES OR OTHER SELLER ERRORS IN DELIVERY,
VISIBLE DEFECTS, PRODUCTS THAT ARE DOA, FAILURE TO MEET SPECIFICATIONS
OR SHIPPING DAMAGE. All claims for shortages or other Seller
errors in delivery, for visible Product defects covered by the Rice
Integration Limited Warranty, that the Products are non-operational
out of the box (Dead on Arrival), that the Products fail to meet
manufacturer specifications, and for shipping damage must be made
within 10 days after receipt of shipment. In the case of shipping
damage, a notation should be made in the carrier's delivery document
and a copy retained by Buyer for return with the Product.
ALL OTHER PRODUCT RETURNS. All other claims under
the Rice Integration Limited Warranty not covered by the preceding
paragraph must be made within the earlier of the following periods:
(1) the lifetime of the Product, (2) the date on which Seller discontinues
sales of the Product, or (3) the date on which the Product becomes
obsolete, provided that in no event shall this period be less than
twelve months from receipt by Buyer of the Product. Notwithstanding
the foregoing sentence, all claims under the Rice Integration Limited
Warranty must be made within fourteen (14) days after discovery by
Buyer of the defect or failure to meet specifications covered by
the Rice Integration Limited Warranty, and all claims under the
Rice Integration Limited Warranty relating to Rambus Products, not
covered by the preceding paragraph, must be made within fourteen (14)
days after receipt of shipment.
PROOF OF PURCHASE. When requesting an RMA number
Buyer must supply the following information: Seller's order number,
Buyer purchase order number, Product part number, serial number,
seller's invoice number, invoice date, date code or lot number,
and any Product failure information, including test reports.
RMA VALIDITY. Upon issuance of an RMA number,
the product must be received within fourteen (14) working days from the date
of the original RMA issuance.
REPLACEMENT OR CREDIT POLICY. RMA's are issued
for replacement or repair only, at Seller's option, and Seller shall
not be obligated to refund the purchase price or issue a merchandise
credit. Seller will, at Seller's option, replace or repair or issue
a merchandise credit with respect to all defective Products (for
which an RMA was issued). In the unlikely event that repair or replacement
of the Product cannot be made within fourteen (14) working days, Buyer
has the choice of waiting until Product becomes available or having
its account credited for future purchases.
PACKAGING AND CONTENTS FOR PRODUCT RETURNS. Product
returned must be packed in original boxes and must include all manuals,
cables, cords, and any other accessories outside of the box. All
returned items MUST be accompanied by a copy of the original Seller
invoice verifying the identity of the purchaser of the Product being
returned. Returned Product which does not meet packaging, content
or documentation requirements is considered incomplete. At Seller's
option, incomplete returns will be shipped back to Buyer at Buyer's
expense in the same condition as received by Seller without notification,
or the returned Products will be replaced or repaired, at Seller's
option, and reshipped together with the missing items or documentation,
for which a charge will be made.
SHIPPING OF RETURNED PRODUCT. A Buyer returning
Products for any reason must prepay freight to Seller. Upon Buyer's
delivery of the Products to the carrier, the carrier shall be deemed
to be an agent of Buyer and all risk of loss, damage, liability
and responsibility for Products shall be on the Buyer. Buyer is
responsible for insurance for damage or loss in shipment of returned
Products. Product shipped C.O.D. will be refused. Seller will pay
freight back to the Buyer when and if it sends a replacement Product
or repaired Product using the same shipping method. Buyer retains
title to Products returned for repair.
